The Real Estate Authority (REA) publishes approved consumer guides to help buyers and sellers understand the key documents used in a residential real estate transaction. Licensed real estate professionals are required to provide the relevant approved guide before a residential seller signs an agency agreement, and before a residential buyer signs a sale and purchase agreement.

Overseas investment

Buying residential property in New Zealand

New Zealand’s overseas investment rules can restrict who may purchase residential property and, in some cases, require consent before a purchase. Eligibility depends on residency or citizenship status, the type of land and other circumstances.

Professional standards

Professional Conduct & Client Care Rules

Mangawhai Real Estate operates under eXp New Zealand Ltd. Licensed real estate professionals are required to comply with the Real Estate Agents Act 2008 and the Real Estate Agents Act (Professional Conduct and Client Care) Rules 2012.

In plain terms, the rules set the minimum standards of conduct and client care that every licensee must meet — acting in good faith, communicating clearly and honestly, disclosing relevant information, and treating everyone involved in a transaction fairly.

Before signing an agency agreement, sale and purchase agreement or other contractual document, you should be given the opportunity to obtain legal advice and, where relevant, technical or other specialist advice.

We want concerns about the service you receive to be dealt with clearly and promptly. You can contact Mangawhai Real Estate in the first instance so we can understand the issue and work through it with eXp New Zealand where appropriate.

Information supplied by vendors and third parties

From time to time Mangawhai Real Estate may provide buyers with property documents, records, reports or other information that has been supplied by the vendor, councils, consultants or other third parties. Where we are simply passing on information supplied to us, it should not be treated as an independent verification by Mangawhai Real Estate or eXp New Zealand Ltd.

Your own due diligence

Property information is provided to assist your investigation, but buyers should make their own enquiries and obtain independent legal, building, technical or other specialist advice where appropriate. Do not rely solely on information passed on by the agency when deciding whether to purchase a property.

Before signing

eXp New Zealand Ltd and its licensees recommend that buyers and sellers seek legal advice before signing a sale and purchase agreement, agency agreement or other contractual document. Technical or other professional advice may also be appropriate depending on the property and circumstances.
